Artingle LLC (“Artingle,” “we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, store, and safeguard information when you access or use the Artingle website, mobile application, and related services (the “Platform”). By accessing or using the Platform, you agree to the practices described in this Privacy Policy.
1. Scope of This Policy
This Privacy Policy applies to personal information collected through the Platform. It does not apply to third-party websites, services, or applications that may be linked to or integrated with Artingle. Your interactions with such third parties are governed by their respective privacy policies, and Artingle is not responsible for their practices.
2. Information We Collect
We collect personal information that you voluntarily provide when you register for an account, create or update your profile, upload portfolio content, send messages, participate in communities, or contact us. This may include your name, email address, username, professional details, portfolio materials, and any other information you choose to share publicly or privately through the Platform.
When you use messaging features, we store message content and related metadata as necessary to provide communication functionality, maintain system integrity, and support community safety. We do not actively monitor all private communications; however, message data may be accessed when investigating reported violations, addressing safety concerns, enforcing our Terms of Service, or complying with legal obligations.
We also automatically collect certain technical and usage information when you interact with the Platform. This may include your IP address, device type, browser type, operating system, application version, session duration, pages visited, click activity, scrolling behavior, and other interaction data. This information helps us improve performance, maintain security, analyze trends, and enhance the user experience.
Artingle uses cookies and similar tracking technologies to operate and improve the Platform. Cookies are small data files stored on your device that enable session functionality, security features, and usage analytics. During the beta stage, we may use analytics providers, including services such as Microsoft Clarity and similar tools, to understand how users interact with the Platform. Microsoft Clarity may collect information regarding browsing behavior, clicks, scrolling activity, and interaction patterns, and may use session replay technology to help us identify usability issues and improve functionality. Sensitive input fields are not intentionally recorded. In the future, we may use additional analytics services, including tools similar to Google Analytics, to analyze aggregated usage trends and improve the Platform. These providers process information in accordance with their own privacy policies. You may control cookies through your browser settings, although disabling certain cookies may affect Platform functionality.
If payment functionality is introduced, transactions may be processed by third-party payment processors. Artingle does not store full credit card numbers or complete payment credentials. Payment data is handled directly by the third-party processor in accordance with their security and privacy standards.
3. How We Use Information
We use personal information to create and manage accounts, enable communication and collaboration between users, provide customer support, maintain security, improve Platform functionality, analyze usage patterns, prevent fraud, enforce our Terms of Service, and comply with legal obligations. Publicly shared content may also be used for promotional or marketing purposes related to Artingle. We do not sell personal information to advertisers, data brokers, or other third parties.
4. How We Share Information
We minimized the usage of third-party service. We may share personal information with trusted third-party service providers that assist us in operating the Platform. These providers may include cloud hosting services, analytics providers, communication infrastructure providers, payment processors, identity verification services, and application distribution platforms. We require such providers to process personal information in accordance with applicable laws and contractual obligations.
We may also disclose information if required by law, court order, governmental request, or if we believe disclosure is necessary to protect the rights, safety, or property of Artingle, our users, or others. We do not sell personal data.
5. Data Retention
We retain personal information for as long as necessary to provide the Platform, comply with legal obligations, resolve disputes, enforce agreements, and maintain security. Because Artingle is currently operating in beta, certain information may be modified, migrated, or deleted as part of system updates, testing, or product improvements. Users are encouraged to maintain independent backups of their portfolio content. You may request account deletion by contacting us, subject to legal and operational requirements.
6. Data Security
We implement reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of internet transmission or electronic storage is completely secure, and we cannot guarantee absolute security. Use of the Platform is at your own risk.
7. Children’s Privacy
Artingle is not intended for users under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that such information has been collected, we will take appropriate steps to delete it.
8. Your Privacy Rights
Depending on your location, you may have certain rights regarding your personal information, including the right to request access to, correction of, deletion of, or restriction of your data. 9. International Users and Data Transfers
Artingle is based in the United States. If you access the Platform from outside the United States, you understand that your personal information may be transferred to, stored, and processed in the United States or other jurisdictions where our service providers operate. These jurisdictions may have data protection laws that differ from those in your country of residence. By using the Platform, you acknowledge and consent to such transfer and processing in accordance with this Privacy Policy. Welcome to Artingle. Artingle is currently operating in a beta stage. This means that certain features may be experimental, incomplete, or subject to change. These Terms of Service (“Terms”) explain how the Platform works, your rights and responsibilities, and the legal framework governing your use of Artingle.
By accessing, registering for, or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Platform.
1. About Artingle
Artingle LLC (“Artingle,” “we,” “us,” or “our”) operates a digital technology platform designed to support creative professionals, organizations, and companies. The Platform enables users to build professional identity, publish and manage creative portfolios, connect and communicate with others, participate in communities and events, and explore collaborative opportunities, whether paid or unpaid.
Artingle functions solely as a technology infrastructure that facilitates interaction among users. Artingle does not act as an employer, staffing agency, broker, legal advisor, escrow provider, financial institution, or guarantor of any agreement formed between users. All collaborations, negotiations, contracts, intellectual property transfers, and financial arrangements occur solely between the participating users. Artingle does not supervise, control, verify, or enforce user agreements and is not responsible for disputes arising from such relationships.
2. Beta Status and Service Changes
Because Artingle is in beta, the Platform may contain errors, bugs, interruptions, or incomplete functionality. Features may be modified, added, restricted, or removed at any time without notice. Artingle may suspend or discontinue all or part of the Platform at its discretion.
You acknowledge that during beta, service interruptions, delays, or data loss may occur. Artingle does not guarantee uninterrupted access, system reliability, or preservation of content. You are responsible for maintaining independent backups of your content and information.Use of the beta Platform is voluntary and at your own risk.
3. Eligibility
Artingle is not intended for users under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that such information has been collected, we will take steps to delete it.
If you are under the age of 18, you represent that you have permission from a parent or legal guardian to use the Platform and that they have reviewed and agreed to these Terms on your behalf.
4. Account Registration and Security
To access certain features, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account.
Artingle may suspend, restrict, or terminate accounts that violate these Terms, compromise Platform security, disrupt the beta environment, or create risk to other users or the Platform.
5. User Content and Ownership
You retain ownership of the content you upload, publish, or share on the Platform (“User Content”), including creative works, images, videos, text, portfolio materials, and other submissions.
By uploading User Content, you grant Artingle a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, format, and promote your publicly shared content for the purposes of operating, testing, improving, and marketing the Platform. This may include featuring publicly available content in newsletters, announcements, promotional materials, or Platform showcases.
You represent and warrant that you have all necessary rights and permissions to upload your content and that it does not infringe any third-party rights or violate applicable law.
Artingle reserves the right to remove content that violates these Terms or applicable laws.
6. Messaging and Community Standards
Artingle provides in-app messaging and communication features to support professional networking and collaboration. Users must communicate respectfully and professionally.
Harassment, threats, discrimination, hate speech, impersonation, coercion, exploitation, fraud, or abusive conduct are strictly prohibited.
Users must not share sensitive personal or financial information through the Platform, including credit card numbers, banking information, government-issued identification numbers, home addresses, or other confidential data. Messaging may not be used to arrange unauthorized off-platform transactions intended to bypass Platform systems or policies.
Artingle does not actively monitor all private communications. However, Artingle may review communications when investigating reported violations, responding to safety concerns, enforcing these Terms, or complying with legal obligations. Users may block other users and report inappropriate behavior. Artingle may investigate reports and take action including warnings, restrictions, suspension, or termination of accounts.
All interactions with other users, whether conducted on or off the Platform, are undertaken at your own discretion and risk.
7. Collaborations and User Disputes
Any collaboration formed through Artingle exists solely between participating users. Artingle does not guarantee payment, performance, quality, deliverables, intellectual property ownership outcomes, or any result of user collaborations.
If disputes arise between users, those disputes must be resolved directly between the involved parties. Artingle has no obligation to mediate, arbitrate, or enforce user agreements. By using the Platform, you release Artingle from claims arising from user interactions and collaborations.
8. Payments and Financial Transactions
If payment functionality is introduced during beta, transactions may be processed by third-party payment providers. Artingle does not store full credit card information and does not control third-party payment systems.
Artingle is not responsible for errors, delays, disputes, chargebacks, or losses arising from third-party payment processors. Users are solely responsible for tax reporting and compliance obligations.
9. Third-Party Services
The Platform may rely on third-party services including hosting providers, cloud infrastructure providers, analytics services, communication tools, identity verification services, payment processors, and application distribution platforms such as the Apple App Store or Google Play.
Artingle engages third-party service providers only as necessary to operate, secure, and improve the Platform. We aim to limit the use of third-party services to those that are essential for functionality, performance, and security.
Artingle does not control and is not responsible for the availability, accuracy, security, performance, or policies of third-party services. Your use of such services may be subject to separate terms and privacy policies.
10. Intellectual Property and Copyright
Artingle respects intellectual property rights. If you believe content on the Platform infringes your copyright, you may submit a written notice identifying the copyrighted work and the allegedly infringing material.
Artingle may remove infringing content and may terminate accounts of repeat infringers.
All Platform software, branding, logos, designs, and technology are owned by Artingle and protected by intellectual property laws. You may not copy, reproduce, reverse engineer, or distribute Platform materials without permission.
11. Privacy
Your use of the Platform is governed by our Privacy Policy. Artingle does not sell personal data. Personal information is collected and processed only as necessary to operate, secure, and improve the Platform.
12. Feedback
If you provide suggestions, comments, or feedback during beta, you grant Artingle the right to use and incorporate such feedback without obligation or compensation.
13. Disclaimer of Warranties
The beta Platform is provided on an “as is” and “as available” basis. Artingle makes no warranties regarding availability, reliability, data preservation, collaboration outcomes, financial results, or security.
14. Limitation of Liability
To the fullest extent permitted by law, Artingle shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the Platform.
15. Indemnification
You agree to indemnify and hold Artingle harmless from claims, damages, liabilities, losses, or expenses arising from your User Content, conduct, collaborations, violation of these Terms, or violation of third-party rights.
16. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of New Jersey, United States. Any disputes between you and Artingle shall be resolved through binding individual arbitration. You waive participation in class actions or class-wide arbitration.
17. Application Distribution Platforms
If you access or download Artingle through the Apple App Store, you acknowledge that Apple is not responsible for the Platform and has no obligation to provide maintenance or support services. Apple is not responsible for addressing any claims relating to the Platform, including product liability claims, legal compliance, or intellectual property claims.
If you access or download Artingle through the Google Play Store or other application distribution platforms, you acknowledge that such platforms are distributors only and are not responsible for the content, operation, maintenance, or support of the Platform.
You agree to comply with all applicable third-party platform terms when accessing Artingle through such services.
18. General Provisions
Artingle may assign these Terms in connection with a merger, acquisition, or restructuring. If any provision is found unenforceable, the remaining provisions remain valid. These Terms constitute the entire agreement between you and Artingle.
19. Changes to These Terms
Artingle may update these Terms at any time. Continued use of the Platform after updates are posted constitutes acceptance of the revised Terms.
